Nairobi, Kenya | By Michael Wandati | The High Court has suspended the Senate’s resolution that upheld the impeachment of former Deputy President Rigathi Gachagua, following a motion passed on Thursday, October 17, 2024.
In a ruling issued on Friday, 18, October 2024 Justice Chacha Mwita stated that Gachagua’s petition presented significant legal and public interest concerns, warranting further examination.
Justice Mwita granted a conservatory order to pause the execution of the impeachment charges, including the appointment of Gachagua’s successor, until October 24, 2024, when the case will be mentioned in court.

The Judge also directed the Chief Justice Martha Koome to form a bench to hear the petition.
“That due the the significance of issues raised in the petition and application, I certify this matter as raising substantial questions of law and public interest and therefore fit to be heard by a bench of uneven number of judges to be appointed by the Hon. The Chief Justice. The file be placed before the Hon. Chief Justice immediately for consideration in that regard,” the ruling read in part.
