Nairobi, kenya | By Michael Wandati | The High Court is set to deliver a crucial ruling on Wednesday regarding whether Deputy Chief Justice Philomena Mwilu has the authority to appoint a three-judge bench to hear Deputy President Rigathi Gachagua’s impeachment case.
Gachagua’s legal team has argued that only the Chief Justice can form such a bench, a stance challenged by the respondents’ lawyers.
All petitions related to Gachagua’s impeachment have been consolidated, with President William Ruto named as a respondent in the case.

On Tuesday, Gachagua personally attended court for the hearing of a petition by the Attorney General, who is seeking the establishment of a three-judge panel to lift the conservatory orders issued by Justices Chacha Mwita and Richard Mwongo. These orders have blocked Kithure Kindiki from assuming the office of Deputy President.
The three-judge bench, led by Justice Eric Ogola, will issue its ruling on Wednesday, October 23, 2024, and later consider recusal petitions filed in the case.
