Gachagua loses bid to stop ruling on Kindiki’s swearing-in as Deputy President

Nairobi, Kenya | By Michael Wandati | The High Court in Nairobi has overturned previous orders that blocked Prof. Kithure Kindiki’s swearing-in as the new Deputy President following the impeachment of Rigathi Gachagua.

The initial orders were issued by the Kerugoya High Court on October 18, 2024, after petitioners David Munyi Mathenge and Peter Gichobi Kamotho highlighted the matter as one of “great national importance and urgency.”

In a recent ruling, a three-judge bench comprising Justices Antony Mrima, Eric Ogola, and Freda Mugambi ruled in favor of allowing the swearing-in process to proceed.

The bench also noted that the case would be mentioned again on November 7, 2024, and that Gachagua is free to appeal the judgment.

“The applications for conservatory orders are hereby disallowed. The conservatory orders issued on October 18, 2024 in Kerugoya High Court are hereby discharged and/or set aside. We grant leave for appeal. Typed proceedings and certified copies of this ruling to be availed to parties at cost. We will mention this matter on November 7, 2024 at 2pm in the open court,” the judges said in the ruling read by Justice Ogola.

Rigathi Gachagua faced another legal setback as the Court of Appeal declined his request to stop the High Court from continuing with proceedings related to his ouster. This development further challenges Gachagua’s position, following a series of legal actions seeking to prevent the swearing-in of Prof. Kithure Kindiki as Deputy President.

The impeached Deputy President, Rigathi Gachagua, has taken his case to the Court of Appeal, expressing dissatisfaction with a recent decision by a three-judge bench. The bench had upheld Deputy Chief Justice (DCJ) Philomena Mwilu’s move to establish the panel overseeing his ouster case.

Gachagua’s appeal reflects ongoing resistance to the rulings that have advanced the proceedings against him.
